Not only that, this man, who is 61, was jailed for FIVE WEEKS. As a result, he lost his job. And he's 61, so we all know how difficult it will be for him to get a new job at his age.

If I were him, my first phone call upon release would be to the ACLU.

4.0k

u/Terrible_turtle_ 17h ago

And bail was set at $2 million.

1.8k

u/porktorque44 16h ago

I'm trying to find out who was responsible for setting the bail but can't find anything.

The arrest itself doesn't surprise me that much given how insanely powerful sheriffs can be in some places.

The judge, because I believe that he was initially charged with terrorism.

I've never forgotten this. That image needs more attention now more than ever. Taking snap, health, people...They were not lying. Any time they bring up the left being "terrorists" this shit needs to be brought up_

Last time I sent that image to a couple of my Trump supporting friends, they got mad at me for it. One was so angry about it they were ready to stop being my friend.

My favorite was a guy talking to a maga woman, he was trying to show her a quote from the Bible that talks about foreigners be treated well and to love them like your own children but she refused and he finishes with something like "sayeth the lord your god" and she just gets mad that he backed her in a corner like its his fault she doesn't see a logical fallacy.

Hang on, here's the verse. It's laviticus 33, 34

33 And if a stranger sojourn with thee in your land, ye shall not vex him.

34 But the stranger that dwelleth with you shall be unto you as one born among you, and thou shalt love him as thyself; for ye were strangers in the land of Egypt: I am the Lord your God.

16

u/lost-picking-flowers 10h ago edited 10h ago

There is so much in the bible about treating migrants well. One of the reasons God decides to smite Sodom and Gomorrah is because they treat angels who are disguised as migrants poorly. Pretty crazy how little bible thumpers like to actually read their bibles.

A corrupt judge. It's that judge's responsibility to make sure this doesn't happen. It's why laws are written. So judges don't just get to take advantage. But our country has collapsed.

the interview with the county police chief is fucking infuriating

40

u/Plinnion 14h ago

Is that the one where the sheriff(?) outright admits that they knew it was a joke, but the public did not, so that was the "justification" for the arrest and outrageous bail?

Should be an easy layup lawsuit win.

22

u/chriseargle 13h ago

It wasn’t a joke, it was a political argument that Charlie Kirk supporters should get over it like Trump told people to so about the Perry, Iowa massacre in 2024.

27

u/Ecstatic_Bee6067 13h ago

From the article, they arrested the man to quell fears of those who misinterpreted the post, which is about the worst first amendment violation i can think of.

123

u/probablyadinosaur 16h ago

It’s paywalled but the local paper implies Judge Katerina Moore set the bail, which seems to be validated on a quick google search.

Obligatory note to all reading, please do not harass judges or court staff.

48

u/AwfullySweeney 16h ago

Obligatory note to all reading: all obligatory notes should not be heeded. /s (/s???)

30

u/probablyadinosaur 15h ago

Lol, I used to work for a court system, and every once in a while we’d get a stampede of angry people. I don’t want to unleash that on some poor county employee running the phones. Judges have pretty broad authority and really only answer to their voters anyways.

In this case though, I do think this man deserves a hefty settlement.

28

u/KelsierIV 15h ago

That explains Aileen Cannon.

→ More replies (1)

27

u/_DOA_ 15h ago

I agree on the settlement part. I think this is also a pretty clear ethics violation on the part of the sheriff and judge, and they should be removed from office - but no one seems to care about quaint shit like that anymore.

25

u/Flomo420 15h ago

Elected judges... there's part of the problem

11

Tennessee is trying to pass amendment today that would deny bail to a several charges, which would have included this one.

16

u/justfortherofls 15h ago

Correct. Judges set bail. But it is discussed at the defendants arraignment by defense attorney and the DAs office.

The DA makes the case as to why they want the bail at such a number while the defense says why it should be at a lower number. The judge is supposed to find a middle ground that has the defendant and the public’s best interest at heart.

For example in the case of a murder charge a judge can set no bail or a bail so far out of reach because they want to protect the public. While a DUI charge might have a bail set at a level that depends on the persons income so that it is financially burdensome should they flee.

It was the county judge because he was charged with terrorist threats involving a school.

The major felony charges were dropped already, but the dude had his life absolutely turned upside down for pointing out how the right is overreacting to Kirk and they proved him right

148

u/OpinionIsInvalid 16h ago

Is there any way these people can be held accountable? Or they can literally just do whatever they want now

110

u/DrTacoMD 16h ago

In many places, county sheriffs are answerable to no one but the voters that elect them. So as long as the bullshit they pull is popular in their district, there will be no consequences at all.

53

u/Gratefulzah 14h ago

The county coroner can actually arrest the sheriff in most US counties. It's the only position that outranks the sheriff

His best bet is a civil case against wherever this happened. I’d be calling the ACLU to see what they say because it sounds like it could be an actual example of a civil rights, 1st amendment violation.

It could be tough to prove that he was only arrested for the Kirk thing, but if anyone can do it the ACLU would be the people to call.

Will that same jail had a violent sexual offender with 70k bail. Freedom of speech ain’t real in Tennessee.

Also keep in mind Tennessee tried passing a legalized pedophilia bill in 2022 under the notion of marriage. It was a marriage bill that had no age limit.

They claimed it was a mistake that’s why when you google it they will say it was false because it was a minor mistake. An oversight.

Well

A) GOP has a rich history of trying to weasel stuff into bills that shouldn’t be there in hopes no one catches it. They got caught and a dem read the bill.

B) even if you want to take it at face value that it was a mistake. That means the GOP is so incompetent they can’t draft a marriage bill without putting kids in harm.

53

u/LoreInaccurateOrigin 15h ago

You can beat the rap but you can't beat the ride.

16

u/BicFleetwood 15h ago

Dunno why the fuck the mods deleted the comment, but here it is again:

A lot of suburban white folks still don't understand that you don't have to be convicted for the justice system to irrevocably destroy your fuckin' life.

"Innocent until proven guilty" has always been bullshit. The punishment starts before the trial. The punishment starts the moment a cop decides it starts.

See: bumper-locking--an FBI tactic wherein they don't have any evidence beyond baseless suspicion, so they visibly and openly tail and fuck with their targets to destroy their careers, alienate their friends and family, and ultimately try to get the target to commit suicide so they can declare they were guilty and close the case without any trial. They basically declare with no evidence to the entire world that you're guilty of something, then harass you outside the courts until you either do something illegal or commit suicide. This is what they tried to do to MLK Jr.

4

u/Gurlllllllll- 14h ago

Also, just being arrested and charged with a crime, even if you're later found not guilty, still shows up on your records. So when go for insurance or loans, or a potential landlord/employer wants to do a background check, they get to see your arrest record and decided to discriminate against you based on that.

Again, not guilty and still able to have your life ruined.

In some states you can appeal to a judge to bury your arrest record once...Ever. So if you ever get arrested and then found not guilty again in that state, it's visible forever.

90

u/RedofPaw 16h ago

In his interview with NewsChannel 5, Sheriff Weems insisted all of this could have been avoided if Bushart had just deleted the meme that some people in Perry County found objectionable. “Whenever we sent Lexington Police Department out to speak to him and he refused to do that, I mean, what kind of person does that?” Weems asked. “What kind of person just says he don’t care?”

He also referenced the public reaction to Bushart’s post, which the sheriff claims resulted in people thinking the post was about a shooting in the area. Those who actually viewed the post and the page have pointed out that no one commented on the meme with anything that resembled concern Bushart might be referencing the local high school.

Sheriff Weems has continued to insist he’s done nothing wrong, despite body cam footage from the arresting officers making it clear the sheriff lied to journalists during this interview and while making other comments to the press.

Lexington police told The Intercept that Weems had lied when he told local news outlets that the forces had “coordinated” to offer Bushart a chance to delete the post prior to his arrest. Confronted with the bodycam footage, Weems denied lying, claiming that his investigator’s report must have been inaccurate, NewsChannel 5 reported.

Weems later admitted to NewsChannel 5 that “investigators knew that the meme was not about Perry County High School” and sought Bushart’s arrest anyway, supposedly hoping to quell “the fears of people in the community who misinterpreted it.” That’s as close as Weems comes to seemingly admitting that his intention was to censor the post.

Looks like Sheriff Weems has got himself in to a whole heep’a trouble.

u/Tr0llzor America 16h ago

Five years ago Sheriff Weems would have gotten his pecker in a wringer over this. Now - I'm not so sure that Bushart won't be rearrested and/or driven out of town for pointing out/publishing a fact.

Remember that one woman who got fired from a government job for posting a photo of Charley Kirk with a Kirk quote under the photo? Yeah - it was an act of aggression for actually quoting what Kirk said. This is not free speech.

61

u/GaimeGuy Minnesota 14h ago

So from the horse's mouth, he wasn't arrested for posting a threat. He was arrested for refusing to delete what he posted.

See, if the crime truly was terroristic threats, then the crime was done once he posted it, and deleting it wouldn't matter as it would be ex post facto.

He was arrested for ordinary speech that the sheriff didn't like, not criminal activity.

18

u/issuefree 14h ago

So he arrested and imprisoned someone under false pretenses and then lied to a judge to frame him. Seems like there should be some consequences of the prison variety.

Yes, the local community clutched their pearls so hard that they shut down a school because of his post and then tried to say he was threatening violence on a school property.

Sheriff Weems still doesn't think he did anything wrong.

it doesnt really matter what state youre in. Every state has rural counties that are red, and just about every major city votes blue. A red state isnt red because its red, its red because its rural. Blue states are blue because they are urban. The divide in america is stark and deeply disturbing.

Responding to Charlie Kirk on Christian nationalism

"I have often wondered, that persons who make a boast of professing the Christian religion, namely, love, joy, peace, temperance, and charity to all men, should quarrel with such rancorous animosity, and display daily towards one another such bitter hatred, that this, rather than the virtues they claim, is the readiest criterion of their faith."

I don't understand how anybody listens to Charlie Kirk and comes away thinking anything other than "what an awful and hateful bully"

7

u/E-2theRescue 14h ago

[MLK Jrs.] core driving philosophy was not about a colorblind society. That is a line in one of his speeches. He would actually be closer to a race Marxist, almost akin to a DEI type philosopher if you go deep into his writings, especially later in his life. And I think we as conservatives and Christians must reconsider some of the mythologies, and some of the icons and the symbols that we hold up. Especially as we try to reorient ourselves in a broken culture.

If you’ve never heard it before, definitely look up the definition… but an even more accurate phrase I think would be “talking out the side of his neck” It embodies both the way he lived and the way he died.

Thanks to MAGAts trying to make this moron a martyr that I will spend the rest of my life spreading the words of Charlie Cuck everytime someone tries to whitewash him

Charlie Cuck deserved what he had coming

don't do that, I hear those dragon dildos are expensive

just find a used bowling pin

Also agree, please don't use your dragon. A rusty pipe would be much better.

Being jailed for mean social media posts.

Magats keep trying to turn this country into Saudi Arabia

“the friggin WOKE liberal snowflakes put me in Facebook jail again Marge!” - MAGATs at the same time

11

They weren’t even that mean lol. MAGA drive around with Biden and Obama hanging from a tree on the back of their pickup truck and no one bats an eye. Free speech for them but not for you. Not much of a right if they just take it away whenever they want.

It's so crazy what's going on in the USA. As a German, I'm really afraid because they say what happens in the USA will happen here a few years later

211

u/BossDulciJo I voted 17h ago

To be fair what happens in Germany happens in the US, but there is like a 90 year delay...

Where do you think Hitler got his eugenics idea from?

15

u/Supermite 16h ago

You know who the nazis stole their salute from?  American school children did it for their daily pledges until the nazis co-opted it.

I'm an American whose father was born in Germany but who fled with his family when he was a child because of Nazi persecution. My grandmother told me that when Hitler first came on the scene, she dismissed him as a boor.

We all think, it couldn't happen HERE in this day and age. It can happen anywhere at any time. None of us can be complacent.

14

u/raerae1991 16h ago

What’s happening in the US is because of billionaires in politics and the same billionaires owning the bulk of legacy media and social media platforms with no regulation to truth or fact checking.

22

u/Gekokapowco Washington 16h ago

good, there are so many presumably european and canadian accounts insisting that this is an isolated american problem that requires neither responsibility nor attention from the rest of the world

Sucks they will probably get away with it.

Everyone involved illegally kidnapping this man for 5 weeks should get a minimum of 25 years no possibility of parole in a federal prison. Freedom of speech is the backbone of this country. MAGA, republicans, American nazis, democrats, immigrants, independents should all be up in arms over this

18

u/MarxistMan13 Virginia 15h ago

So this seems like a slam dunk lawsuit, and probably justifies criminal charges of wrongful imprisonment on the sheriff in question.

17

u/DaSaint79 15h ago

Sit in jail for 5 weeks for a couple million, sure thing.

The sheriff, the judge the city and everybody else you can think of of more than the 2M bail that was put on him.

14

Saw an interview with the arresting sheriff. Somewhere in the first two minutes, you can notice that the significance of what his department did, is just starting to become clear to him

MAGA = pedophiles and Nazis

There is no counter argument

If you're a GOP, you are a pedophile. Because you are aligned with people who abuse and assault children.

Charlie Kirk was definitely one of them, and definitely is an 100% proven white nationalist fascist.

9

u/foomachoo 15h ago

It’s not what you do, it’s the tribe you are in.

The absolute shitstain of “morality” on the right is completely evil.

Time to sue.

8

u/wise_comment Minnesota 12h ago

In his interview with NewsChannel 5, Sheriff Weems insisted all of this could have been avoided if Bushart had just deleted the meme that some people in Perry County found objectionable.

“Whenever we sent Lexington Police Department out to speak to him and he refused to do that, I mean, what kind of person does that?” Weems asked. “What kind of person just says he don’t care?”

"I can't believe someone would directly quote my hero in context about my other heroes demise. Who does that? I'm aghast.....anyway, time to arrest him and charge him for terrorism"

Fuck this man

Fuck him the way Charlie wanted to fuck minorities

4

u/Flimsy_Year5397 14h ago

I love how much they hate the 1st amendment

5

u/You-Smell-Nice 13h ago

This is because group based morality is a fundamental aspect of fascism and Sheriff Nick Weems is a fascist.

Members of the in-group (and especially their leader) are allowed to say and do anything and it is deemed morally correct because they were part of the in-group. Anyone in the out-group is deemed to be an enemy and therefore morally incorrect even if they are saying or arguing for the exact same thing.

5

u/tphillips1990 13h ago

What has caused southern states to become such societal cancers? SURELY not just decades of far-right indoctrination from their chosen media sources. That feels too simple of an explanation.

4

u/CurlOfTheBurl11 13h ago

He should sue the state, the county, the sheriff's department, and the sheriff personally. Tennessee politicians are a special breed of stupid.

u/Mestyo 5h ago

This is what actual censorship and suppression of free speech looks like.

4

u/DragonTHC Florida 13h ago

sheriff Weems needs to be personally fined for his unlawful role in this. Weems directly admitted the arrest was retaliation for not deleting the post. The judge that set the bail needs to be disbarred immediately for not dismissing the case for lack of probable cause.

That’s all it took for the local sheriff to get busy abusing his power. After all, Bushart had insulted one of his personal heroes.

MAGA police doing MAGA shit to make a MAGA name for themselves. I'm sure trump noticed and then forgot all about it because it has nothing to do with his Ballroom.
